Featured listing and advertising agreement

These advertising terms apply when you purchase a paid featured listing on weightloss.com.au (“the site”, “we”, “us”). By subscribing to a featured listing you (“the advertiser”, “you”) agree to these terms. All prices are in Australian dollars (AUD).

1. What a paid featured listing includes

A paid featured listing gives you:

• A dedicated profile page for your business
• Featured placement above standard free listings in relevant directory results
• Your business logo and up to five (5) photos
• An enquiry button so visitors can contact you directly

The exact features included may vary between plans and may change over time. Current plan details are shown on our pricing page.

2. Subscription and automatic renewal

A featured listing is a subscription. Your subscription automatically renews at the end of each paid term for a further term of the same length, at the then-current price, using the payment method on file, unless you cancel before the renewal date. Payments are processed by Stripe.

3. Commitment terms

Featured listings are offered on the following commitment terms:

• Monthly
• Three (3) months
• Six (6) months
• Annual (twelve months)

You choose your commitment term at checkout. Each term renews automatically for a further term of the same length as described in section 2.

4. Cancellation runs to the end of the term, no refund

You can cancel at any time. When you cancel, your featured placement and profile page stay live until the end of the period you have already paid for. We do not provide refunds or pro-rata credits for the unused part of a paid term.

At the end of the paid period, your subscription will not renew, and your featured listing reverts to a standard free listing. See our refund policy for more detail.

5. Price changes

We may change the price of a featured listing. If we change the price that applies to your subscription, we will give you reasonable advance notice before the change takes effect at your next renewal. If you do not want to renew at the new price, you can cancel before the renewal date.

6. Content licence

You grant weightloss.com.au a non-exclusive, royalty-free licence to host, display, reproduce, resize, and format the logo, images, and copy you provide, for the purpose of displaying and promoting your listing on the site and in related marketing. This licence continues while your content is displayed on the site.

7. Your warranties

By advertising with us, you warrant that:

• You own or operate the business being advertised, and you are authorised to enter into this agreement
• You own or have the rights and permissions needed to supply the logo, images, and copy, and their display by us does not infringe any third party's rights
• The content you provide is accurate, current, and not misleading or deceptive

8. Our right to moderate content

We may review, edit, moderate, refuse, remove, or downgrade any listing or content at our discretion, including where we consider it inaccurate, misleading, unlawful, or otherwise unsuitable for the site. Where we remove or downgrade a listing because of a breach of these terms, no refund is payable.

9. Your advertising obligations

You are responsible for ensuring your listing and content comply with all laws that apply to you, including the Australian Consumer Law. If you are a health provider, you are also responsible for complying with the advertising rules of the Australian Health Practitioner Regulation Agency (AHPRA) and the Therapeutic Goods Administration (TGA). This includes not making misleading weight-loss claims and not using prohibited testimonials or reviews in your advertising.

10. GST and tax invoices

Prices shown for featured listings include GST where applicable. A tax invoice is provided for each payment through Stripe.

11. Limitation of liability

To the fullest extent permitted by law, weightloss.com.au and its operators are not liable for any loss, damage, or lost business arising from your featured listing, including any interruption to the site, loss of placement, or the volume or quality of enquiries. We do not guarantee any particular number of enquiries, leads, clicks, or results from a featured listing.

Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify weightloss.com.au and its operators against any claim, loss, or cost arising from the content you provide or from your breach of these terms, including any claim that your content is inaccurate, misleading, or infringes a third party's rights.

13. Governing law

This agreement is governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and the courts of Australia hearing appeals from them.
